Trademarks:  Using Amazon Brand Registry

Amazon recently launched a trademark registration process where sellers can register their registered trademarks with Amazon Brand Registry and prevent other sellers from using their registered trademarks.  When you register your federal trademark on Amazon Brand Registry, Amazon will remove from Amazon products sold be other sellers that use the federal trademark

The requirements are:

  • You must have a standard character federal trademark); and

  • Add the federal trademark to the Amazon Brand Registry.

 

Note, the federal trademark must be a standard, character mark and stylized or include a logo, special fonts or colors.  If you have a federal stylized or colored federal trademark (includes logos) Amazon will not add it to the Amazon Brand Registry.   This mean that your trademark consists of a logo, is stylized or includes colored fonts and a competitor uses the same trademark or a word only version of your trademark, Amazon will not remove the competitor’s product from Amazon.  Your only recourses are to commence a trademark infringement lawsuit in federal court or file a new federal trademark application for the word version of the trademark.  Unfortunately, merely because the stylized version of the federal trademark was previously granted, there’s no guarantee the standard character version of the trademark can also be registered.
